A portion of Taiwanese people have a demand for surrogate pregnancy which involves numerous legal issues. The process of surrogate pregnancy is complex and depends on the cooperation of the surrogate, commissioning parent(s) and various professionals. Surrogacy laws and regulations should be formulated, and strict management should be implemented. The purpose of this article is to analyze the necessary components of surrogate laws and provide suggestions for relevant laws and regulations in Taiwan. An evaluation and comparison of foreign surrogacy laws with previous amendments to Taiwan’s Assisted Reproduction Act concerning surrogate pregnancy is conducted. The basic elements and subsidiary norms of surrogacy legislation are examined, with recommendations for the structures of surrogacy contracts and regulations of intermediary agencies and medical institutions. Finally, suggestions for the draft amendments to Taiwan’s Assisted Reproduction Act related to surrogate pregnancy, which passed the first reading in 2020, are provided, aiming to establish strict and comprehensive regulations to ensure the success of surrogacy while protecting the rights and interests of children from surrogate pregnancy, surrogates and commissioning parents. |
