A legal and comprehensive surrogacy contract is one of the key factors for the successful implementation of surrogacy. The surrogacy contract should protect the rights of the surrogate, the child (children) from surrogate pregnancy, and the commissioning parent(s). surrogacy agencies should assist in drafting the legal surrogacy contract, ensuring that all parties involved are fully informed and provide consent. The terms of the surrogacy contract can refer to well-established international surrogacy agreements. The structure of the surrogacy contract should include: (1) basic information, (2) pre-implementation assessment, (3) medical procedures, (4) special prenatal examinations and treatments, (5) remuneration and compensation, (6) medical, insurance, and other related expenses, (7) parent-child relationships, (8) status changes, (9) contract termination and dispute resolution, and (10) other related matters. Administrative authorities should specify the contract structure in the future regulations for surrogacy reproduction under the national assisted reproduction law. It would also be advisable to develop a model surrogacy contract for parties to reference, to assist in the successful execution of surrogacy arrangements. |
