便利營商視野下的營商民事司法改革——以世界銀行營商環境新評估體系中的“解決商業糾紛”為視角

Business Civil Justice Reform from the Perspective of Business Facilitation——From the Perspective of the ''Commercial Dispute Resolution'' Index of the Business Enabling Environment Project

世界銀行營商環境新評估體系將“執行合同”調整為“解決商業糾紛”，需在“執行合同”制度史分析上把握“解決商業糾紛”的內涵並分析兩者異同。營商民事司法構造包括營商與民事司法的關係、營商民事司法制度理念、營商民事司法程序機制等，可視為法系融合第三波。我國營商民事司法改革表現良好，“解決商業糾紛”指數下我國營商民事司法面臨新的挑戰。未來中國民事司法應深度參與全球法治營商交流，形塑公共產品屬性與司法規律相契合的民事司法功能觀，建構裁判請求權下的“法院－當事人”關係，促進民事司法改革系統集成，有品質地減少糾紛解決耗時，構建外向型營商司法評估指數，以電子訴訟規則構建引領全球法院自動化，在新一輪全球營商司法評估中起到應有作用。

The Business Enabling Environment Project of the World Bank adjusted ''contract enforcing'' index to ''commercial dispute resolution'' index. We need to grasp the connotation of ''commercial dispute resolution'' and analyze the similarities and differences between them in the analysis of the history of ''contract enforcing''. The structure of business civil justice includes the relationship between business and civil justice, the concept of business civil justice system, the mechanism of business civil justice procedure and so on, which can be regarded as the third wave of legal system integration. In China, the business civil justice reform has a good performance. Under the background of ''commercial dispute resolution'' index, China's business civil justice is facing new challenges. In the future, China's civil justice should deeply participate in the global legal business exchanges. We should shape the concept of civil judicial function, which is consistent with the attributes of public products and judicial laws, promote the integration of civil judicial reform system, reduce the time of dispute resolution qualitatively, build an export - oriented business judicial evaluation index system, and lead the global court automation with the construction of electronic litigation rules. At the same time, it plays an active role in the new global business justice assessment.
