數字時代法院司法警察職權行使的因應

隨著近年來數字審判的快速發展，特別是2020年新型冠狀病毒感染疫情以來，遠程在線審判在全球獲得了前所未有的快速發展，從民事審判向刑事審判擴展，案件範圍也不斷擴大。數字時代法院司法警察押解、看管，傳帶出庭，傳遞、展示證據等工作場景發生了變化。法院司法警察的職權範圍、工作環境和內容、理念、知識與技能等面臨新挑戰。應當明確司法警察的應急處置權、制定《司法警察參與遠程在線庭審工作規則》、完善配套制度、增強司法警察的數字技術運用能力、完善網絡及遠程審判設施。

In the digital era, the working scenes of the judicial police of the court have changed, such as escort, custody, bringing to court, and transmitting and displaying evidence. The scope of authority, working environment, content, concept, knowledge and skills of the judicial police of the court are facing new challenges. We should make clear the judicial police's emergency disposal power, formulate the Working Rules for Judicial Police to Participate in Remote Online Court Trial, improve the supporting system and enhance the judicial police's digital technology application ability, and improve network and remote trial facilities.
