設置駐中華民國日本國大使館的法律依據變革之考察

A Study on the History of Revisions to the Legal Basis for Establishing the Embassy of Japan in the Republic of China

日本於1952年4月28日與中華民國簽訂《中華民國與日本國間和平條約》，同年8月5日與中華民國復交。於是，日本也在中華民國設置了駐外使館（大使館）。然在1972年9月29日，日本與中華民國斷交後，這種制度就消失了。
但，從設置日本駐中華民國大使館的法律依據來看，日本駐中華民國大使館所在地可能使用的文字是「台灣」也可能是「中華民國」，其文字稱呼並不一致，因此，本文重新確認日本與中華民國建交時代，以日本駐中華民國大使館設置法律依據的修改歷史為重點考察，作為日台關係史的一部分，重新來思考對於「中華民國」日本該稱為是「台灣」還是「中華民國」？而這篇論文的結論是，其實日本似乎並不特別關注其名稱為何，不論是叫「台灣」還是「中華民國」都不太引起日本的興趣。

Japan signed the“Peace Treaty between Japan and the Republic of China”on April 28, 1952, and restored diplomatic relations with the Republic of China on August 5 of the same year. As a result, Japan also established an overseas diplomatic mission in the Republic of China.
However, the establishment of the Japanese Embassy in the Republic of China is not consistent, with its location being“Taiwan”and“Republic of China”. Therefore, this paper reconfirms the revision history of the legal basis for the establishment of the Japanese Embassy in the Republic of China, and examines whether the“Republic of China”was“Taiwan”for Japan as part of the history of Japan-Taiwan relations.
