2011年3月11日發生的東日本大地震和隨之而來的核電站事故,台灣從同月25日起暫停進口福島周邊五縣生產的食品。因此,該措施將於2022年2月21日取消。本文主要從法理角度考察了圍繞此次進口暫停的日台關係。 本文的結論是,台灣消費者權益保護法第36條是該措施的法律依據之一,依此條是適當的,以及日本單方面要求台灣檢討暫停進口措施,並沒有為首相安倍晉三的造假標籤和虛假言論找藉口,所以台日關係是單方面的。 Due to the Great East Japan Earthquake that occurred on March 11, 2011 and the accompanying nuclear power plant accident, Taiwan suspended the import of food products produced in the five prefectures surrounding Fukushima from the 25th of the same month. This measure will consequently be lifted on February 21, 2022. This paper examines the Japan-Taiwan relationship surrounding this import suspension, mainly from the perspective of jurisprudence. The conclusion of this paper is that Article 36 of Taiwan's Consumer Protection Act is one of the legal grounds for the measure, and that it is appropriate in accordance with this article,and Prime Minister Shinzo Abe's false remarks. |
