經濟社會及文化權利國際公約健康權對原住民族保障之規範與實踐研究──兼評我國原住民族健康法草案

Research on the articles and practices of protecting indigenous peoples’right to health according to the International Covenant on Economic Social and Cultural Rights—Comments on the draft of the Indigenous Peoples Health Law in Taiwan

本文藉由經社文公約與我國法體系對健康權之內容進行分析，並透過經社文公約和國內法對於原住民族健康權之保障內涵，檢視原住民族健康法草案，是否達成此權利內容之相關基準，期以對原住民族健康法之草擬與立法方向有所助益，以落實我國對於原住民族健康權之保障。

The study analyzed the contents of the right to health through the International Covenant on Economic, Social and Cultural Rights ICESCR））, and domestic legal system. Then, the author reviewed the draft of the Indigenous Peoples Health Law in Taiwan and discussed the articles according to ICESCR and domestic law. The purpose is to investigate whether the Indigenous Peoples Health Law reached the relevant benchmarks for indigenous peoples’right in ICESCR. The findings of the study would suggest directions for drafting the Indigenous Peoples Health Law and legislation, which would help implement the protection of indigenous peoples’health right in Taiwan.
