Technological progress has led to changes in platform liability, which in turn has given rise to a special means of regulation: the technology safe harbor. At present, China’s platform liability system is built around the agent liability system. Although this regulatory strategy has exerted strong external regulatory pressure on platforms, the regulation on illegal content and behavior is still exposed to many unsolved problems, presented in scenarios such as online piracy, personal information leakage, online violence, data security, etc. As a novel legal regulatory mechanism against the background of the rise of “private power”, technology safe harbor is a legal tool that is seriously underestimated in the current platform liability system in China. The reality of China’s platform liability system is too harsh and rough, and the incentive of technical regulation is insufficient. Thus, China’s regulators should take advantage of the opportunity brought by the development of technology for platform governance, and build the platform liability system around the technology safe harbor. This change will render platform governance more cost-effective and more adaptable to the iteration of technology, thereby improving the status quo of platform governance in China and meeting the needs of the healthy and orderly development of the platform economy. |
