Deviation of causal process is not a kind of cognitive mistake of facts, but the deviation between the specific causal process and the perpetrator's prediction after the commencement of the conduct. In essence, it is a matter about result imputation of the intentional accomplished offender rather than the recognition of conduct intention. The wrong definition of this matter in the theory of mistakes leads to the mistakes in analysis method and the ambiguity of the criterions. The theory of objective imputation is incomplete because of the lack of subjective criterion, which results in internal logical contradiction and legitimacy crisis. The essence of result imputation is the completeness of illegality in intentional accomplished offender, the method is to verify whether the overlapped part of the subjective and objective facts is included in the risks prohibited by law. To analyze the deviation of causal process, we shall first compare the risk-related basic facts recognized by the perpetrator with the objective facts, and describe the overlapped parts of them. Then, by standing at the time point of conduct, we shall consider law of causation and goal of normalized protection jurisdiction, judging from the view of the adjudicator whether the overlapped parts of subjective and objective facts can be judged as the creation and realization of risks prohibited by law. |
