“基本”與“其他”：對《民事訴訟法》相關制度和程序修訂的體系化思考

Basic and ''Other'': Systematic Reflections on Revision of Relevant Systems and Procedures of Civil Procedure Law

2021年《民事訴訟法》修訂主要涉及獨任制、司法確認、小額訴訟的適用範圍、以及在線訴訟及送達規則等，對作為基本制度和基本程序的合議制、普通程序、傳統線下訴訟、送達等都構成衝擊。需要明確民事訴訟法以公正為基本價值，以司法審判為基本功能，以合議制為基本制度，以普通程序為基本程序。其他制度和程序都服務於民事訴訟法的基本價值和基本功能。應當以“基本”與“其他”之間的關係衡平為核心線索，實現民事訴訟法律規範的體系化、科學化建構。

The 2021 Amendment of the Civil Procedure Law mainly involves the applicable scope of sole-judge, judicial confirmation and small claims procedure, the rules of online trial and online service, which may bring negative impact on the collegial system, ordinary procedure, traditional trial and common service. It is necessary to make it clear that the civil procedure law takes justice as the basic value, judicial trial as the basic function, collegial system as the basic system and ordinary procedure as the basic procedure. Other systems and procedures should serve the basic values and functions. We should take the balance of the relationship between ''basic'' and ''others'', and construct the legal norms of civil procedure law in a systematic and scientific way.
