習近平法治思想中涉外法治話語生成與實踐邏輯──以“一帶一路”倡議為視角

Generation and Practical Logic of Foreign- Related Rule of Law Discourse in Xi Jinping's Thought on Rule of Law

在習近平法治思想中，堅持統籌推進國內法治與涉外法治已成為當前指導中國開展涉外法治工作的重要指針和發展方向。而“一帶一路”建設正是這一話語生成的重要實踐場所。從其發展演變來看，“一帶一路”涉外法治實踐不僅體現了習近平法治思想中的規則意識、安全意識以及公平公正意識，而且亦形成了反制、競爭與合作的具體實踐路徑。更為重要的是，在全球治理上，人類命運共同體、共商共建共享原則都揭示出新的國際法命題。因此，未來“一帶一路”涉外法治實踐應緊密圍繞習近平法治思想，加快涉外法治戰略布局，形成强有力的涉外法治保障體系，以期促進“一帶一路”高質量發展，重塑國際法治新秩序。

Under Xi Jinping's Thought on the Rule of Law, it has become a significant guidance for China to carry out upholding coordination between domestic and foreign- related rule of law. The guidance is closely related to The Road and Belt Initiative (The RBI). From the perspective of its evolution, foreign- related rule of law in The RBI not only reflects these discourses on rule, security, and justice, but also creates a concreted approach on countermeasure, competition, and cooperation. What's more, it has contributed for the global rule of law, which are a Community of Shared Future for Mankind (CSFM) and Extensive Consultation, Joint Contribution and Shared Benefits (ECJCSB). Therefore, in the future, it should be upholding Xi Jinping's Thought on the Rule of Law, accelerate the strategic layout of our work on foreign-related rule of law, build a strong foreign-related legal safeguard system, to promote The REI's high-quality development and reshape the paradigm on international rule of law.
