以創新生態系建構研發成果衍生新創法制

Deriving the Legal System of Research Spin-Off from Innovation Ecosystem

英國創新生態系以「資金」、「知識」與「人才」三大創新關鍵資源，串連橫跨政府、大學、研究機構與產業等利害關係人於創新活動的互動關係，詮釋由政府補資助科技研發、大學與研究機構產出研發成果，到研發成果技術移轉予產業或衍生新創公司，帶動產業創新與經濟發展的過程；並以提高創新生態系中創新關鍵資源的流動效率，作為建構創新法制之指引。本文借鏡英國創新生態系架構，應用於我國科技研發補助，探討我國與英國創新生態系之異同，並進一步以創新生態系的思維盤點與檢視我國科技計畫研發成果衍生新創相關法制，提出以整合創新關鍵資源並落實新創法制，方能有效導引創新資源流動之法制建議。

The UK innovation ecosystem connects innovation stakeholders including government, universities, research institutions, and industry by the three key resources of innovation "finance", "knowledge", and "talent". Referring to the concept of the UK innovation ecosystem to promote resource flow efficiency, this article applies to Taiwan's innovation ecosystem of R&D Grants such as Technology Development Program (TDP) and its research spin-offs. This article proposes that to integrate the key resources of innovation and to implement the new innovative regulations with their stakeholders are the keys to lead resource flow and promote resources exchange efficiency.
