New Strategy for Trade Secrets Protection of Taiwan: With Focused on Preliminary Injunction

近來智慧財產權保護之重心，已經逐漸從專利移轉至營業秘密；尤以我國人才濟濟，營業秘密令世界各國虎視眈眈垂涎不已，對於企業經營者而言，除非能於第一時間定暫時狀態處分迅速止血，否則幾乎無可能防免損害之不可回復性、極大的證據滅失與人員逃逸可能性。本文透過實務上經常發生的糾紛型態加以瞭解、歸納、分析，以探討相關法規是否有何不足，而若有必須透過裁判造法的情形又是如何，並對學術界、實務界、修法方向，提出建議，以期能形成良好的產業法秩序、調和各方權益。

In recent years, the focus of intellectual property rights protection has gradually shifted from patents to trade secrets; in particular, there are many elites in Taiwan. Countries all over the world covet Taiwan's business secrets. For business operators, if they want to protect their business secrets, they must deal with it immediately if their business secrets are violated, otherwise it is almost impossible to avoid damage, loss of evidence, and escape of personnel. This article understands, summarizes, and analyzes the types of disputes that frequently occur in cases to explore whether there are any shortcomings in relevant laws and regulations, and make suggestions for academic, practical, and law revision directions, with a view to forming a good industrial law order and reconciliation Rights and interests of all parties.
