信託法上の受託者への規制の日中台比較

在日本，信託是指將財產權轉讓或以其他方式處分給他人，以便根據特定目的監督或處分財產。然而，雖然大體相似，但中國大陸和台灣對信任的定義略有不同。為此，本文旨在確認日本、中國和台灣對信託的定義，並比較和研究信託法對受託人的限制。特別是在中國，預計對受託人的規定會有很大的不同，因為它是一種在受信託目的限制的情況下處分財產並保證受益人的受益權和各種債權的信託。本文的結論是，日本是可以靈活應對的立法，中國是必須以信託法承諾的立法，而台灣則位於日本和中國之間。

信託とは、日本では、一定の目的に従って財産の監理または処分をさせるため、他人に財産権の移転その他の処分をすることをいう。しかし、おおむね類似しているが中国や台湾では、信託についてこれとは若干異なる定義を置いている。このことから、日本・中国・台湾の信託の定義を確認し、信託法上の受託者への規制を比較検討することが本稿の目的である。特に中国では信託の趣旨により制限を受けながら財産を処分し、受益者の受益権および各種請求権をも保障することが信託とされているため、受託者への規制も大きく異なることが予想されるためである。本稿の結論としては、日本は臨機応変な対応が可能な法制であり、中国は信託行為による約定の通りにしなければならない法制で、台湾は日本と中国の中間と位置づける。
In Japan, a trust means the transfer or other disposition of property rights to another person in order to supervise or dispose of the property according to a certain purpose. However, although generally similar, China and Taiwan have slightly different definitions of trust. For this reason, the purpose of this paper is to confirm the definitions of trusts in Japan, China, and Taiwan, and to compare and examine the restrictions on trustees under the Trust Law. Especially in China, it is expected that the regulations on trustees will be significantly different because it is a trust to dispose of property while being restricted by the purpose of the trust and to guarantee the beneficiarys beneficiary right and various claims. The conclusion of this paper is that Japan is a legislation that can respond flexibly, China is a legislation that must be as promised by a trust act, and Taiwan is positioned between Japan and China.
