演藝經紀契約糾紛事件時有所聞,本文透過文獻蒐集分析及深度訪談,探討演藝經紀契約關係之定性、契約內容及糾紛發生原因,試圖找出改善方法。本文發現實務上多認為演藝經紀契約屬類似委任性質之勞務給付契約,藝人與經紀方並非僱傭關係。又我國演藝經紀契約多屬於全經紀約,經紀方像是在投資、培訓與管理藝人,若藝人對於經紀方的安排不滿意,卻無法拒絕或自行接洽其他工作,因此容易產生糾紛;又該契約內容多在規範藝人,但藝人為了得到人脈與資源,或是欠缺對產業、法律的相關知識,在未理解前就先同意,後續便常常因雙方對契約的認知差異而產生糾紛。考量我國現況與借鏡國外經驗,本研究提出建議如下:1.以定型化契約之指導方式,規範應記載與不得記載之事項。2.建立藝人提供勞務期間之投保機制。3.提升經紀方與演藝人員相關知能。
英文摘要
Contract disputes often occur. Through research methods such as literature review and in-depth interviews, there is discussion of the relationship between the entertainers and the agent, the content of the contract, the reasons for the dispute. The study found that most of the talent agency contract in our country are exclusive talent agency contract. The agent seems to be investing, training and managing entertainer. If the entertainer is not satisfied with the agent's arrangements, they cannot refuse or engage in other jobs on their own, so disputes are likely to arise. In addition, the content of the contract mostly regulates the entertainer, bit in order to obtain resources or lack the relevant knowledge of industry and law, the entertainer signs the contract before understanding it. As a result, disputes often arise due to the cognitive differences between the two sides of the contract. Finally, the study proposes specific policy recommendations as follows. 1. Standardizing the items to be recorded and not to be recorded by the way of standardized contract. 2. Establishing an insurance system during the period when entertainers provide labor services. 3. Legal subsidies being provided for economically disadvantaged entertainers.
