"At the outset, this paper analyzes the international jurisdictional rules by adopting a comparative study method. From these analyses, we can divide international jurisdictional rules into two categories. One can be further divided into general international jurisdictional rule and specific international jurisdictional rule; the other is the jurisdictional factors and discretionary rule. By these types of international jurisdictional rules, the author aims to shape R.O.C.’s international jurisdictional rule. The first dimension of shaping jurisdictional rule is to refrain from the principle of territorial sovereignty of public international law. The second dimension of shaping jurisdictional rule is based on the jurisdiction factors. The third dimension of shaping jurisdictional rule is based on the discretionary factors as exercised by the courts to decline jurisdiction. While shaping international jurisdictional rules, we have to consider the protection of parties’ litigation rights as well." |
