電子支付時代下財產犯罪成立的類型化研究：以支付寶為例的分析

支付寶存在著餘額、餘額寶、銀行卡、螞蟻花唄、親情號等不同的支付方式，對此展開類型化的研究具有重要的理論與實踐意義。利用上述支付方式實施取得他人財物的行為在刑法上主要存在著盜竊罪、詐騙罪與信用卡詐騙罪不同的規制思路。雖然盜竊罪並不包括利益盜竊，但卻可以將支付寶餘額視為物權客體從而納入盜竊罪的對象。在電子支付時代，詐騙罪的主要問題是如何理解「陷入錯誤」的要素，對此可以將作為信用支付產品的螞蟻花唄作出與餘額不同的解釋，在肯定螞蟻小貸需要審核合法用戶身份的基礎上，肯定相關行為詐騙罪的可罰性。對於利用支付寶中綁定的銀行卡取得他人財物的行為，可以認定為信用卡詐騙罪。而借助親情號實施的財產犯罪則需要區分盜竊他人賬號綁定、欺騙他人予以綁定以及私自修改額度三種類型進行分析。最後，即便在解釋論上可以用現行法予以規制相關犯罪，但在立法論上仍應新設計算機詐騙罪。

The act of using the bank card bound in Alipay to obtain the property of others can be regarded as the crime of credit card fraud. However, property crimes carried out with the help of family accounts need to be analyzed in three types: theft of others' account binding, deception of others to bind it, and private modification of the quota. Finally, even if the current law can be used to regulate related crimes in terms of interpretation, the crime of computer fraud should still be established in the legislation."
