"Alipay has different payment methods such as balance, Yu' E Bao, Card Repay, Huabei, family account, etc. The research on these different types has important theoretical and practical significance. In criminal law, there are different rules and regulations of theft, fraud and credit card fraud in the act of obtaining other people's property by using the above payment methods. Although the crime of theft does not include the theft of profits, the balance of Alipay can be regarded as the objects of real right and should therefore be included in the crime of theft. In the era of electronic payment, the main problem of the crime of fraud is how to understand the element of ''falling into error''. In this regard, Huabei, which is a credit payment product, can be explained differently from the balance. Given that Ant Microloans needs to review legitimate users' identities, such acts can be punished under the crime of fraud. The act of using the bank card bound in Alipay to obtain the property of others can be regarded as the crime of credit card fraud. However, property crimes carried out with the help of family accounts need to be analyzed in three types: theft of others' account binding, deception of others to bind it, and private modification of the quota. Finally, even if the current law can be used to regulate related crimes in terms of interpretation, the crime of computer fraud should still be established in the legislation." |
