依憲治國的中國邏輯

“人民共和國憲法觀”是依憲治國的理論前提，也是“憲法的中國學”得以形成的基本立場。“人民共和國憲法觀”以“人民憲法”為立憲之基礎，包含“黨領導人民制憲”“憲法實現人民主權與公民權利同構”兩個基本命題；“人民憲法”形成了以“總章程”和“根本法”為兩軸的基本框架，並通過憲法實施服務於治國理政的目標，進而建構了適應這個邏輯要求的全覆蓋合憲性審查。

The “Constitutional Conception of the PRC” serves as the theoretical premise of the Rule of the Constitution, and also the basic standpoint for the formation of “Chinese Studies of the Constitution”, where the People’s Constitution sets the basis for constitution-making, with two basic propositions: “the Communist Party leads the people in constitution-making” and “the constitution realizes the isomorphism of People’s sovereignty and civil rights”. The “People’s Constitution” has formed a basic frame work with “General Constitution” and“Fundamental Law”as two axes, and has served the goal of country governance and politics ruling through constitutional implementation, thus constructing a comprehensive constitutional review regime that meets this logical requirement.
