我國犯罪三大幫派屬性之研究

A Study on the Attributes of the Three Big Gangs

由於當前國內學界對於我國司法與實務所認證之犯罪三大幫派整體組織及成員之特性研究並不多，因此，本研究欲以系統性之實證途徑對於三大幫派及其成員屬性現況與彼此間之關係進行瞭解與分析。本研究以2018年12月31日為基準日，就官方基準日時所現有之239個竹聯幫、天道盟及四海幫及其所屬分支單位抽取全數資料進行歸納與統計，包括幫派與成員之歸納屬性與及關聯性，以及進入刑事司法體系後之押執處置情況進行分析。研究發現三大幫派高度集中在大都會地區，其中又以北部之雙北地區為最高，而三大幫派不論是在分支數及成員數之幫派規模上，以竹聯幫為最大，而天道盟則在平均之成員數、吸收女性及學生少年作為成員之比率最高；然而在大多數之幫派成員屬性中之就業狀況均無顯著差異，普遍來說多無固定職業，就業狀況並不理想。依據研究發現，本研究提出以下建議：一、竹聯幫等三大幫派危害性極高，應持續列為聚焦打擊之優先標的；二、對於吸收未成年及學生應持續加強教育宣導、預防與查緝作為；三、成員失業比率過高，政府提供職業訓練機會協助就業實刻不容緩。

This study explored the so called Three Big Gangs’ attributes through scientific and empirical approaches. Studies on Three Big Gangs related characteristics are rare but actually significant and essential to analyze the status quo and their attributes. The author analyzed data from official databases accessed on 31 Dec. 2018. What are analyzed and designed as variables includes Three Big Gangs’ attributes as a whole. It was also verified the relationships among Three Big Gangs members’ detention while facing the treatment of criminal justice system. The study found that the majority of gangs were highly centralized in metropolises especially in the Taipei and New Taipei cities among the northern cities in Taiwan. The so called the “Bamboo Union” had the largest scale including gang branches and members. The “Heavenly Way Alliance” stood the highest ratio no matters in the gang member average as well as recruitment of the female and young student or minority. The Three Big Gangs also showed the higher rate of unemployment and detention while facing the legal treatment during the process of criminal justice system. Three suggestions and strategies were proposed in the study based on the results as follows: To keep continuity on the suppression of so called the most pernicious syndicate “Three Big Gangs”. To promote law education among students and minors; and invest resources on providing occupational training and opportunities for unemployed gang members.
