台湾の原住民族政策と日本のアイヌ政策

Taiwan’s Aboriginal Policy and Japan’s Ainu Policy

日本では、2019年4月に「アイヌ施策推進法」が公布され、5月より施行された。同法は、アイヌ民族が先住民族であることを明記した日本において初の法律だが、アイヌ民族が先住民族であることに法的効果が結びついているわけではない。他方、台湾では、既に様々な原住民族政策が実施されており、台湾の原住民族に関連する政治的動向は、日本のアイヌ民族に関連するものとは大きく異なっている。 本稿は、台湾の原住民族政策と日本のアイヌ政策それぞれの背景にある台湾と日本の憲法事情、および原住民族とアイヌ民族の現状に基づいて、台湾の原住民族政策と日本のアイヌ政策の差異を明らかにしようと試みるものである。

In Japan, the“Ainu Policy Promotion Act”was enacted in April 2019 and came into effect in May. This is the first law in Japan that clearly states that the ainu people are indigenous people, but the legal effect is not linked to the fact that the ainu people are indigenous people. On the other hand, various indigenous policies have already been implemented in Taiwan, and the political trends related to Taiwan's indigenous peoples are very different from those related to the ainu people in Japan. This paper is attempt to clarify the difference between the indigenous policies in Taiwan and the ainu policies in Japan, basing on the constitutional circumstances in Taiwan and Japan, and the current situation of the indigenous peoples and the ainu people.
