我國道路交通法律架構之研究

The Structural Aoalysis on Road Traffic Law System

道路交通的構成要素包括道路、用路人、車輛，以至於環境，故於學理土道路交通行政之基本法律應包含以下四種:一是以規範道路建設、維護及安全設施為主的「道路建設法」二是以規範車輛設備(安全基準)、牌照及檢驗等為主的「道路車輛法」三是以規範大小客、貨運業營運為主的「道路運輸業法」四是以規範通行方及使用道路的權利義務為主的「道路交通法」。在我國道路交通行政幾十年來的蓬勃發展中，法亦隨之權宜修改增吉丁，使得當今我們的道路交通法律體~錯綜複雜，產生一些不合邏輯的地方亦可見不當的授權命令逾越母法，或者應該以法律規定之事項卻暫時以行政命令充當的現象。因，巫需妥善規劃整合立法，以健全道路交通行政之法律體祟。本研究首先解析我國現行道路交通令體系，其次研析現行法令努構之問題，而復藉由交通學理與先進國家日、德、美等國法律祭構分析，研提我國道路交通法令架構之調整獨主義。本研究之成果，可以作為修正我國現行道路交法律架構與研擬未來道路交通行政相關法律之參考。

Since the basic elements of road traffic include roadway, road users, vehicles and environment, the road traffic administration is based on road construction law, vehicle law, commercial transportation service law and traffic law. In our country, the road traffic law system has grown rapidly for decades, but there exists so many unreasonable and unsystematic regulations and rules. This stere attempts to integrate the road traffic law system and to conjure up a vision ofthefuture. This study begins with the analysis of current road trajJìc law system and it's problems. Secondly, it reviews the road traffic law structure of Japan, Germany, and United States. Finally, it makes a proposal about the future road traffic system and the steps to reach it. The findings and suggestions of this study could be used for reference to adjust current laws system and describe future laws and regulations.
