論自動駕駛車輛事故於我國之過失侵權責任──以德國道路交通法2017年修正為借鏡

A Study of Negligent Tort Liability about Autonomous Vehicles: Focusing on Amendments to the Road Traffic Act of 2017 in Germany

為應對自動駕駛車輛將於我國道路行駛之不久將來，本文先行檢視相關交通事故可能適用之我國民法過失侵權行為規範，並參考德國道路交通法就自動駕駛車輛駕駛人應負之行為義務以及美國SAE自駕車分級標準，進而對自動駕駛車輛所涉事故之駕駛人過失內涵提出進一步具體討論，期望成為司法實務或道路交通相關規範之重要參考，以求衡平新興科技與法律權益保障。

In order to face autonomous vehicles (AV) driving on the road in the near future, this paper reviews the laws about torts civil liability in Taiwan and refers to the AV standard of SAE as well as amendments about AV drivers' duty to the Road Traffic Act of 2017 In Germany. Based on above materials, this paper not only expects to bring up specifying opinions on AV drivers' duty of care to torts civil liability in Taiwan but also looks forward to be an important suggestion of judgements or amendments to the Road Traffic Management and Penalty Act in Taiwan.
