民法典適用銜接問題研究

《民法典》適用銜接問題是民法法源理論面對的首要解釋論課題。《民法典》並不是民法體系化的終點，反倒是民法和民法學再體系化的起點。《民法典》適用銜接主要聚焦《民法典》與原有民事基本法的關係、《民法典》與民商事特別法的適用關係、《民法典》與民商事司法解釋的適用關係、《民法典》頒行後民商事指導案例的調適、《民法典》的時間效力等。須結合具體條文、立法變遷及編纂立法的特殊性，類型化討論《民法典》適用銜接問題，實現對《民法典》的再體系化、再科學化，發揮《民法典》的體系效益，展現動態法源觀。

The connection of the application of Civil Code is the primary interpretative topic faced by the theory of sources of civil law. Civil Code is not the end of civil law systematization, but the starting point of re-systematization of civil law. The application of Civil Code is mainly focused on the relationship between Civil Code and the original civil basic law, between Civil Code and the special law of civil and commercial affairs, between the Civil Code and the judicial interpretation of civil and commercial affairs, the adjustment of the civil and commercial guidance cases after the promulgation of the Civil Code, and the time effect of the Civil Code, and so on. We should combine the specific provisions, legislative changes and the particularity of codification legislation to discuss the systematization between the Civil Code and other legislation in different types, in order to realize the re-systematization and re-scientization of the Civil Code, to develop the system benefit of civil code and to show the dynamic sources of law. The theory of the source of civil law is not limited to the static form of law. Rather, it shall be open to the dynamic conflict coordination of the source of law, forming dynamic sources of law. Dynamic sources of law are the new methodology put forward by the‘codification’legislation of Civil Code.
