疫情防控法律體系優化的邏輯及展開

新冠疫情對我國社會、經濟、政治等多方面帶來了前所未有的衝擊和持續影響，其影響遠遠超出了單純的醫學和技術的範圍，對法律、制度、公共治理具有深遠影響。疫情對國家法治體系，尤其是公共衛生法治體系，對國家治理體系和治理能力建設，為現行傳染病防控和應急機制等都帶來了重大而直接的挑戰。運用法治手段和方式進行疫情防控是法治國家的基本要求，具有其內在邏輯，應當遵循這種邏輯，完善疫情防控法治化的現實路徑及有效模式，完善我國的公共衛生法律制度。將疫情防控納入制度化、法律化框架，這既有利於對疫情風險的預防和控制，也是推進國家治理體系和治理能力現代化的有機組成部分。

COVID-19 pandemic poses unprecedented challenges to and long-lasting impacts on China s social, economic and political sectors. Its significance is far broader than the fields of medicine and technology. This article presents the challenges brought by this pandemic to the rule of law and particularly to the health legal system, to the national governance system and capacity, to the current mechanisms of communicable diseases control and health emergency management, in order to analyze the logical engagement of law in the containment of the pandemic, its practical pathway and functions and to demonstrate enormous impetus that the legal containment exerts on the construction and perfection of the country’s governance system, health law system and particularly public health law, and communicable disease control mechanisms. Based on such analyses, it offers suggestions for improving the health law system and for perfecting the mechanisms of communicable disease control and health emergency management.
