論行政特許產生的要素及過程

相對於行政行為論、法律關係論，行政過程論可以提供新的研究行政特許產生的視角。根據過程論的“全面考察”思想，可以發現行政特許產生需直接規範要素、客觀範圍要素等形式要素，以及職權要素、權利要素（含其他主體一般權利、新興權利）等實體要素。在過程論動態考察思想的視野下，行政特許的產生體現為實體要素上僅包括職權要素、實體要素上包括職權要素＋其他主體一般權利以及實體要素上包括職權要素+新興權利等三種特徵各異的情形。基於過程論的多方關注思想，行政特許產生不僅涉及行政主體和申請人，還會涉及徵收、佔有和轉換其他主體權利，需完善相關的分類規制。

This article proposes are fined study on the generation creation of administrative franchise from the perspective of administrative process theory. According to the thought of ''comprehensive analysis'' of administrative process theory, taking elements as the tool to comprehensively analyze the generation creation of administrative franchise, the generation of administrative franchise we will find that it needs formalistict elements, such as the direct norm requirements and the objective scope specification, and entity substantive elements, such as authority element and right element(It includes the general rights of other subjects and the emerging(sphere)rights). According to the thought of ''dynamic analysis'' of the process theory, based on the composition of different entity elements, the generation creation of administrative franchise includes three conditions to separately study the different characteristics of three kinds of concrete process. First, entity substantive element only includes authority element; second, entity substantive elements include authority element and other general rights of other subjects; third, entity substantive elements include authority element and emerging(sphere)rights. According to the thought of ''comprehensive attention of different parties'' of the theory of process etc, to improve the three processes of the generation of administrative franchise, the generation creation of administrative franchise not only involves the administrative subject and applicant, but also may involves occupation and conversion and levying the general rights of other subjects. Therefore, it is necessary to improve the relevant specialized controlling system.
