Different from the popular perspective approach of ''law and literature'', this paper attempts to re-examine the legal studies scholarship on the film the Story of Qiuju from the perspective of critical legal studies, so asaiming to investigate the genealogy of critical legal studies in China. Professor Su Li is the first one to study this film and care about the ''confusion of Qiuju'' so as to criticize the mainstream western universalist view of the rule of law in China. He insisted advocated legal pluralism and legal functionalism to the rule of law, hoping to construct a new kind of the rule of law with ''local resources'' in China. Since then, the interpretation of the Story of Qiuju formed two theoretical peaks camps in criticizing mainstream western universalist view of the rule of law in China. One is professor Feng Xiang s criticism from the left-wing position of Christian theory and communist theory, in which he criticized legal transplantation in China as building aprovince of the global capitalist empire. The other is pProfessor Zhao Xiaoli s criticism from the conservative position of Chinese classical tradition. He criticized that the rule of western law in China has destroyeding the meaning of life and the way of living. On the one hand, this paper attempts to provide an internal clue for thinking about the development of legal theories in China in the past 40 years since the beginning of the age of reforming and opening upopening and reform; on the other hand, it also hopes attempts to promote China to explore a new development path of rule of law and build an ideal legal order with legal pluralism for China. |
