This paper sorts out the theoretical background and intellectual lineage of ''normative order'' legal studies from the perspective of academic history, and comprehensively introduces the lessons that ''normative order'' school may offer to the development of Chinese law. The paper emphasizes that Chinese legal theory should directly face the challenge of globalization and provide a construction theory of normative order. With the rise of limited government, human rights protection and colonial independence, the school of ''normative order'', which originated in Frankfurt, proposes an academic agenda comprising both the particular and universal, the descriptive and the normative and the history and reality, by reconstructing the studies of complex systems theory, critical theory and European legal history. This paper reveals the context, perspectives and issues of ''normative order'' research, highlighting the tradition, achievement and future development. Finally, this paper will point out the implications of this academic context for the theoretical study of Chinese jurisprudence: the development of Chinese jurisprudence is carried out in the historical process of legal globalization, which requires Chinese law research to reflect more of the global historical perspective and social transformation concerns. |
