Against the background of establishing a law-based country, government, and society and expanding the local legislative power according to the amended Legislation Law, it is necessary to give more attention to the integrated development of folk norms and the local legislation. Based on the principle of unity of opposites, we can infer that there is the potential to achieve the integrated development of folk norms and the local legislation. Folk norms characteristics of sociality, inheritance and experience echo the local legislation’s characteristics of locality, inherence and enforceability respectively. Admittedly, folk norm’s characteristics of conservatism, spontaneity and bottom-up approach contradict with the local legislation’s characteristics of innovation, construction and top-down approach, which brings barriers to the integrated development of folk norms and the local legislation. However, such barriers are not insurmountable. In other words, the negative proposition of the integrated development of folk norms and the local legislation is falsifiable. The possible approach to achieving the integrated development of folk norms and the local legislation is: folk norms introduce the local legislation; the local legislation absorbs folk norms; folk norms supplement the local legislation; the local legislation guides and regulates folk norms, which demonstrates a two-way interaction and boosts the process of comprehensively advancing the rule of law and modernization of governance capability. |
