論民間規範與地方立法的融合發展

在“法治國家、法治政府、法治社會一體建設”和《立法法》修改後地方立法主體擴容的背景下，應充分關注民間規範與地方立法的融合發展問題。基於對立統一關係的原理，民間規範與地方立法存在融合發展的基礎；民間規範的社群性、傳承性和經驗性分別能溝通地方立法的地方性、固有性和執行性，又使得二者具備融合發展的可能。當然，二者融合發展也面臨一定的障礙，如民間規範守成，地方立法卻創新；民間規範自發，地方立法卻建構；民間規範自下而定，地方立法卻據上而立等。但這些障礙並非不可消解，亦即二者不能融合發展的命題是可以被“證偽”的。民間規範與地方立法融合發展的具體路徑為：民間規範先導地方立法，地方立法吸收民間規範，民間規範補充地方立法，地方立法規引民間規範，呈現出雙向互動的迴圈態勢，助推全面依法治國及國家治理現代化的進程。

Against the background of establishing a law-based country, government, and society and expanding the local legislative power according to the amended Legislation Law, it is necessary to give more attention to the integrated development of folk norms and the local legislation. Based on the principle of unity of opposites, we can infer that there is the potential to achieve the integrated development of folk norms and the local legislation. Folk norms characteristics of sociality, inheritance and experience echo the local legislation’s characteristics of locality, inherence and enforceability respectively. Admittedly, folk norm’s characteristics of conservatism, spontaneity and bottom-up approach contradict with the local legislation’s characteristics of innovation, construction and top-down approach, which brings barriers to the integrated development of folk norms and the local legislation. However, such barriers are not insurmountable. In other words, the negative proposition of the integrated development of folk norms and the local legislation is falsifiable. The possible approach to achieving the integrated development of folk norms and the local legislation is: folk norms introduce the local legislation; the local legislation absorbs folk norms; folk norms supplement the local legislation; the local legislation guides and regulates folk norms, which demonstrates a two-way interaction and boosts the process of comprehensively advancing the rule of law and modernization of governance capability.
