南海諸島主權權利之爭端解決可能性：以帝汶海合作案為例

The Lessons from the Case between Timor-Leste and Australia toward a Possibility of the Settlement of–Sovereign Right of the Disputed Islands in the South China Sea

東帝汶與澳洲於 2018 年 3 月 6 日達成帝汶海劃界協議，解決兩國長久以來的海域爭議。因此本研究旨在思考如何藉由此成功解決爭端案例，作為解決南海諸島主權權利爭端的借鏡。研究發現如下：第一，確立爭議海域地物主權與爭議海域範圍；第二，澳洲妥協的意願；第三，信心建立措施的採用；第四，採用擱置主權爭議，油氣資源共同開發的方式作為解決爭議的第一步。研究建議：南海油氣資源共同開發可從爭議國家少的地方進行合作，進而為多方合作創造有利環境。

Timor-Leste and Australia reached an agreement on the demarcation of the Timor Sea on March 6, 2018 resolving the long-standing sea disputes between them. As such, this study considers how to apply the principles of this successful case as a way to solve the disputes of sovereign rights in the South China Sea. The findings are as follows: (1) the need to ascertain who owns the sovereignty of the disputed islands and where disputed maritime areas are; (2) the willingness of Australia to compromise on major issues; (3) the adoption of Confidence-Building Measures; (4) setting aside sovereignty issues and adopting joint development of hydrocarbon deposits. The research suggests that joint development of hydrocarbon deposits could begin in a small maritime area with only two claimants and if successful could create a favorable environment to expand cooperation with more claimants.
