發展觀光條例第53條之合憲性研究－－簡評台北高等行政法院96年度簡字第85號判決

The Study of constitutionality for 'Article53 of Statute for the Development of Tourism'：The Review in Taipei High Administration Courts Judgment 96 Chien Zi No.85

本文主要從台北高等行政法院96年度簡字第85號判決出發，討論有關觀光業者（觀光旅館業、旅館業、旅行業、觀光遊樂業或民宿經營者）違反發展觀光條例第53條之問題。本文研究認為發展觀光條例第53條涉及到對於觀光業者於憲法上所保障營業自由之侵害，故應依據明確之法律或法律授權之法規命令始得限制。惟系爭發展觀光條例第53條規定有違反法律明確性原則之違憲疑義，對於業者產生不明確的基本權利(營業自由)限制，因此建議應修法將主管機關所欲禁止之行為予以明文規定。

This study is that discuss the Constitutionality for 'Article 53 of Statute for the Development of Tourism'in Taiwan, and we choice the Taipei High Administration Courts Judgment （96 Chien Zi No.85）to explain why the 'Article 53 of Statute for the Development of Tourism'contravene the Article 15 （Right to work）and 23 of Constitution. In this study, we find'Article 53 of Statute for the Development of Tourism'is unconstitutional because it imposes unclear restrictions about the right to work of tourist agencies. The recommendations of this study are the legislature should be define prohibited act clearly in Statute for the Development of Tourism'.
