管制創新與創新實驗機制在臺灣的未來與挑戰

The Future and Challenges of Regulating Innovation and Innovation Experiments in Taiwan

本文參考管制如何規範創新的政策爭論、金融科技監理沙盒的發展趨勢、金融科技草案的相關討論、日本產業競爭力強化法的管制革新，以及歐盟的創新協議，建議臺灣應以專法或在中小企業發展條例等適宜法律中，規劃適用於金融業以外所有領域的創新實驗機制，並就引入灰色地帶消除制度、主管機關協調與參與機制、個案化豁免法令之明確授權暨落地機制等事項提出建言。

After reviewing the debates on regulating innovation, the development of fintech and regulatory sandbox, the discussions about the draft of Fintech Innovation Experiment Act, the regulatory reform prescribed in Japan’s Industrial Competiveness Enhancement Act, and the Innovation Deals advocated by the European Commission, this article suggests that Taiwan enact a special act, or create a particular chapter in an appropriate act, such as Act for Development of Small and Medium Enterprises, for establishing an innovation experiment scheme applying to the industries other than the financial sector. Then this article further proposes the principles for establishing an innovation experiment system, including introduction of removing gray zones program, the cooperation and participation of the competent authorities,clear authorizations to exempt the related laws and regulations on a case-by-case basis, and the planning of post-experiment phrase.
