資料與網路虛擬財產的民法保護

Protection of Data and Virtual Property in Civil Law

中國大陸《民法總則》力圖對互聯網引發的各種新問題的規範給予回應，以彰顯民法典的時代特徵。在財產法領域，集中體現在《民法總則》第127條對資料、網路虛擬財產的引致性規定。本文作者首先對《民法總則》有關資料、網路虛擬財產的立法進程進行整體性介紹；隨後，透過回顧資料、網路虛擬財產相關的理論爭議，闡明第127條的立法選擇考量；最後，本文作者還對第127條的規範性質與功能以及現有資料、網路虛擬財產相關司法實踐加以分析、梳理。

The Civil Code of Republic of China shall reflect the epoch feature of the era of Internet. Article 127 of the General Principles of the Civil Code provides protection of data and virtual property. This article focuses on Article 127 of the General Principles of the Civil Code. Firstly, this article starts with analysis of the legislative process of establishing Article 127. Then, this article introduces the main theoretical arguments of data and virtual property, and demonstrates the legislation purpose of Article 127. In the end, this article discusses the normative property and function of Article 127 as well as relevant judicial decisions.
