In this paper, we discuss the lawsuit strategy and motive of Council of Labor Affairs. We argue that Council of Labor Affairs used lawsuits as tool to shirk responsibility, not to exercise the right of claims. In the beginning, the Council of Labor Affairs postponed the cases of Closed Factory Workers for several years. After Control Yuan concerned this case, Council of Labor Affairs started the lawsuits. However, when some judges transferred cases to Administrative Litigation Division, the Council of Labor Affairs did not oppose and appeal it. When High Administrative Courts made a ruling some cases of Closed Factory Workers as public law litigation, the Council of Labor Affairs just ignored the fact it won most of cases in District Courts and withdraw all cases. In short, the Council of Labor Affairs saw the cases of Closed Factory Workers as political difficult issue. They used lawsuit to avoid political and legal duty. |
