The Judgment Effects of Intervention

參加人參與本訴訟，如其訴訟活動未受訴訟進行程度及被參加人行為所妨礙，於被參加人敗訴時，固應分擔敗訴責任，不得對被參加人爭執本訴訟之裁判不當；於被參加人勝訴時，二人之間亦生爭點效，以維護其參加訴訟所取得法律上地位；而參加人與他造當事人間仍受既判力及爭點效擴張所及，始符誠信原則及彼此間公平。此等參加訴訟之判決效，係賦予參加人程序保障之後，擴大訴訟參加制度之統一解決紛爭功能，俾維持訴訟經濟及保護程序利益。

The intervener, if not prevented by the progress of actions or the Parties in the actionto be intervened, may not dispute the correctness of the decisions made in the actionagainst the supported party. On the other hand, if the decisions made in the action are infavor of the supported party, the effect of issue preclusion will also occur in between. Asfor the intervener and the other Party, due to the good faith principle and fairness, both arestill restricted by the binding force and the effect of issue preclusion. Theseaforementioned effects of judgments expand the “resolve-related-disputes-in-oneproceeding”function of intervention system after procedural protection and thus maintainlitigation economy and protect procedural interests.
