論親屬身分關係的事實性

On the Defacto Feature of Kinship

文章首先分析了親屬關係的事實性的三方面內容：1.事實性表現為身分法律行為的目的性；2.事實性是身分秩序穩定性的要求；3.事實性是身分關係客觀性的體現。其次，探討了親屬身分關係事實性的兩個作用：1.事實性是身分行為的重要標誌；2.事實性是檢驗親屬身分關係存在與否的標準。最後，提出了從道德、法律和公序良俗方面對親屬身分的事實性進行效力判斷，從而判斷現實生活中存在的事實婚姻和事實收養等身分行為的法律效力。

This paper first analyzes the defacto feature of kinship in three aspects: 1. Thefactuality performance as the purposiveness of the identity legal act; 2. The factualityis the requirement of the identity stability of the order. 3. The factuality is theembodiment of the objectivity about the personal status relationship. Secondly, thispaper discusses the two functions about defacto feature of kinship: 1. The factuality isan important symbol of the act of identity; 2. The factuality is the standard for testingthe relationship exists or not. Finally, the paper puts forward the method aboutjudging the defacto feature of kinship from the aspects of moral, legal and publicorder and moral, in order to judge the force of law about the act of identity as de factomarriage and de facto adoption that exist in the real life.
