Based on the legal action (such as contract, etc.) of transferring real estate right, Mainland China, in principle ,adopts the creditor format, what combines intention and registration. On the basis of the legal theory, the reasons of transferring real estate right are validity of contract, which of the main problem is the flaws of declaration of intention, and the legal form of the public, which of the main problem is without going through registration procedures. As a consequence, in practice, it is necessary and feasible to consider the validity of contract and the registration.
