Monitoring Technology Equipments and Traffic Enforcement

將監視科技設備或措施納入執法過程中，逐漸成為當代執法趨勢。尤其是針對交通違規事件的執法，往往以自動測速或自動感應照相設備為之，甚或輔以監視器之運用，例如高速公路上的雷達測速照相、闖越紅燈照相或公共道路裝設監視設備等，都已經是行之多年的執法方式。此種仰賴監控科技設備進行交通執法的模式，已經成為事實，那麼，針對其所涉及的法律爭議予以分析，應該有其必要性。為釐清上述爭議，本文將從我國法制現狀出發，分別檢視警察職權行使法第十條與道路交通管理處罰條例第七條之二，以及相關規定之限制，接著，進一步以我國釋憲實務與比較法之觀點，就監視科技設備執法所涉及之「隱私保護」與「正當法律程序保障」等爭議，展開討論。

It is becoming a contemporary trend that including monitoring technology equipments in the enforcement processes. Especially the cases of traffic enforcement tend to using automatic speed measurements or sensor cameras, even with the help of monitors. For example, radar speed cameras set on freeways, red-light cameras, or monitoring equipments set on highways, all are means of enforcement for many years. The model of traffic enforcements that depends on monitoring technology equipments has been the reality, then it should be necessary to analyzing the legal controversies involved in the model. For clarifying the controversies, this article is based on the legal status quo of our country, and inspects the Article 10 of the Police Power Exercise Act and the Article 7-2 of the Road Traffic Management and Penalty Act and the limits of the relevant regulations. Next, this article, from the perspective of practices of constitutional interpretation of our country and comparative law, discuss on the controversies of enforcement through monitoring technology equipment that concerning “privacy protection” and “due process” further.
