電子文件及電子簽章係依隨科技發展而對於法律形成造成影響的重要事例，其對於實體法上及程序上均產生部分爭議及需予面對及克服的難題。本文僅企圖對於二者之意義及在程序法上部分基本問題加以介紹。至於在證據價值之判斷的問題，則另文處理。

Electronic records and electronic signatures are important embodiments about how technology development affects law evolvement. They result in difficult questions for both substantive and procedural law. This article only aims to introduce the meanings and basic questions of electronic records and electronic signatures under procedural law. As for the judgment of evidential values, we will analyze in another article.
