護理行為之刑事過失－以不作為犯為例

Criminal Negligence on Nursing Behaviors－Using Omission Crime as Examples

刑法上過失致人於死或傷害罪，所稱的過失行為，包括「作為」與「不作為」。「不作為」犯罪指對於結果的發生，法律上有防止的義務，能防止而不防止者，與因積極行為發生結果者同。護理人員在過失「不作為」中刑事責任的相關議題缺少專文探討，故本文探討護理行為之「不作為」犯罪，並解析護理人員在何種情況下成立過失不作為犯。本文可協助護理人員明瞭護理行為的「不作為」犯罪、及其法律責任。

Both an ‘act’ and ‘failure to act’ (omission) can be crimes. Omission is defined as the failure to act when you know you have a duty to act and have the ability to act. The studies on criminal judgments to omission negligence in nursing behaviors have usually been neglected. This article aims to explore the negative crime of nursing behaviors and analyses in what condition nurses become negative crime. It is expected that this article will assist nurses in understanding the negative crime and relevant legal responsibility.
