本文討論刑法是否應該另立專法處罰散布他人私密照的行為，不論該專法是獨立的構成要件或現有構成要件的加重規定。本文從法益、刑事政策及構成要件明確性等三種觀點分析，主張上述任何一種專法都不適宜新增納入我國現有刑法體系。

This article discusses about whether to establish a specific paragraph for distributing other peoples private pictures, regardless of using independent requisite elements or just aggravating the incumbent regulations. This article conducts analysis in terms of legal interests, criminal policy and the clarity of requisite elements, and thus manifests that none of the aforementioned models should be incorporated into the existing criminal law system.
