In order to explore the interaction of the personal data protection and the fair trade market in the digital economy era, the thesis was conducted to do a case study of the German Federal Cartel Agency’s decision v. Facebook in 2019, which ban Facebook from collecting data. Not only analyzing the German’s latest judicial practice, it also introduced the new draft bill on the 10th amendment to the German Act against Restraints of Competition (ARC-Draft bill). We take ARC-Draft bill as a response to the competition legal system in the digital age and tried to explore how foreign governments can shape their new digital market order in the era of digital competition, and how to tame the tech titans who absorb these huge data. |
