數位時代下科技巨頭的馴服術──談德國數位市場競爭法制與政策發展

Taming the Tech Titans－in the Digital Age: On the Germany’s Competition Law and Policy in the Digital Market

本文從2019年德國聯邦卡特爾署裁決禁止臉書蒐集資料一案之探討出發，探索數位經濟時代個人資料法制與公平交易市場法制的交錯領域議題，同時介紹2019年德國政府所提出之第十次限制競爭防止法草案，並以之作為對數位時代下競爭法制的回應。試圖從最新外國司法實務與立法動向分析，探索數位競爭時代下外國政府如何形塑其數位市場新秩序，與馴服駕馭這些吸納龐大資料的科技巨頭們的方法。

In order to explore the interaction of the personal data protection and the fair trade market in the digital economy era, the thesis was conducted to do a case study of the German Federal Cartel Agency’s decision v. Facebook in 2019, which ban Facebook from collecting data. Not only analyzing the German’s latest judicial practice, it also introduced the new draft bill on the 10th amendment to the German Act against Restraints of Competition (ARC-Draft bill). We take ARC-Draft bill as a response to the competition legal system in the digital age and tried to explore how foreign governments can shape their new digital market order in the era of digital competition, and how to tame the tech titans who absorb these huge data.
