德國少年監獄替代模式之介紹──以自由型態之少年監獄行刑為核心

Introduction on the Alternative Mode of German Juvenile Prison: On the Free Mode of Juvenile Prison

德國Baden-Württemberg邦的「Chance計畫」是全德國知名的以自由型態模式來運行少年刑罰的執行，其運行模式自2003年起已有十年以上的經驗累積，也有相對應的評估研究成果提出。本文係針對德國少年監獄行刑的自由型態模式之狀況，以及德國少年監獄行刑的自由型態模式之實證觀察成果與再犯研究等等加以說明與介紹。再依本文對於德國少年監獄行刑之自由型態模式的相關探討，對於我國在少年感化教育在多元收容制度與多元處遇措施等方面提出建議意見。

The ''Chance Plan'' in Baden-Württemberg in Germany, is a wellknown implementation of the execution of juvenile punishment in a free mode. Its operating mode has accumulated more than ten years of experience since 2003, and there are corresponding evaluation research results. This article explains and introduces the situation of the free-form mode of execution in german juvenile prisons, as well as the empirical observations and recidivism studies of the free-form mode of execution in german juvenile prisons. Based on the related discussion on the free-form model of execution in german juvenile prisons, this article gives suggestions on multiple accommodation systems and multiple treatment measures for juvenile correction education in Taiwan.
