初探人工智慧的民事法律責任－－從歐洲議會機器人民事法律規範建議開展

A Preliminary Study of the Civil Liability about AI : Focusing on European Parliament resolution of 16 February 2017 with recommendations to the Commission on Civil Law Rules on Robotics

本文從歐洲議會向歐盟執委會所提出開發機器人民事法律規範建議作為開展，首先介紹其內容概述、機器人定義和其民事責任上所提及的爭點。並將相關議題對應至人工智慧於我國可能之民事責任規範，進行細部分析，包括：一、機器人作為法律主體之可行性|二、機器人之契約責任|三、機器人之侵權責任，最後提出本文之結論，在商品設計者、製造者及消費者、使用者之間取得衡平，則是未來人工智慧之民事責任規範進行調整的主要考量原則。

This paper discusses the European Parliament's Resolution of 16 February 2017 with recommendations to the Commission on Civil Law Rules on Robotics. First, it provides a brief summary of the content of the Resolution and looks at the issues of defining robots and their civil liabilities. To correspond to the issues mentioned above, this paper analysis the civil liabilities about robot in Taiwan, including: 1.The feasibility of robot's legal personality| 2.The contract liabilities of robot| 3.The tort liabilities of robot. This paper make a conclusion that we have to do is consider to adjust our civil law system, and striking a balance between designers, manufacturers, consumers, and users.
