接受刑後強制治療之性侵害者對該方案之態度初探

The Study for the Attitude of Sex Offenders among the Post-Imprisonment Mandatory Treatment

依據性侵害防治法，再犯評估危險者刑後得令於適當處所進行刑後強制治療，而此處所現今依然為「監獄」。本研究之目的在於了解其性侵害受刑人面對刑滿後尚須留在獄中接受治療有何感想與看法，以及影響其參與刑後治療之因素。而本研究亦廣收文獻資料以示至今年5月之性侵害犯罪概況，包含累積在監、新入監、出監人數。刑後強制治療之爭議與疑慮一直未有定論，包括一事二罰、不定期刑、溯及既往、平等原則等諸多法律基本原則之適用問題。訪談則依據隨機抽取之監所-台中監獄，進行質性訪談，總共訪談四位性侵害加害人，一對一輪流進行。研究結果發現，家庭、監獄生活、法制面、自我調適與其他原因較容易左右受刑人之參與意願，也提及對於現行法制的不滿與因應方式。

According to existing laws, the sex offenders might go to mandatory treatment even though they had finish imprisonment turn, if they were assessed to be high risk. Even the location for the mandatory treatment is in a hospital among prison, still it is a "prison".The study aims to understand the feelings and views of sexual abuse inmates faced the treatment after served the sentence and the impact of the factors participating in the treatment. The controversy and concerns of the treatment afterserving the sentence has not yet been settled, including double jeopardy, post ex facto, the principle of equality.The study interviewed four sex offenders individually in the mandatory treatment. The results showed that family, life in prison, legal system, self-adjustment and the reasons will affect the willingness to participate in treatment after they served thesentence. The dissatisfaction with the existing legal system and ways of coping were also included.
