病態性倒錯之暴露症者刑事處分與處遇

Criminal Disposal and Treatment of Exhibitionism

我國針對性侵害犯罪之治療與處遇模式於近年來急遽發展，目前位居亞洲國家中前位。然而，筆者等過往研究文獻卻發現，病態心理者之性侵犯行為，例如：「潑精癖」、「觸摸癖」、「暴露症」，因其犯罪行為多樣化，在於刑事處分上極易產生量刑不均與僅對於部分病態心理類型病患進行強制治療外，實務上並無其他治療方式處應。病態心理性倒錯者是一種再犯率高，加上後續容易導致性侵害犯罪行為。對於心理病態型性倒錯患者如何進行一個較為共識性的刑事處分與後續治療處遇建議是我國目前學術研究上一個極大之欠缺，亟待補正，此更突顯了本研究之價值與高度重要性。本研究主要聚焦於性倒錯症之暴露症（亦即公然猥褻行為人）之量刑與處遇狀況。研究方式主要以文獻分析法，採全國法院判決資料之彙整與分析，希冀達至下列研究目的：其一、將我國近四年來所謂公然猥褻罪之犯罪類型樣態與概況進行分析；其二、分析與解析暴露症之公然猥褻罪之量刑情形；其三、針對前述判決之意見之中，檢閱行為人是否有精神相關疾病以及法官是否依據行為人之狀況進行量刑。

Taiwan has been one of the Asian countries where the sex crime treatments are highly developed. However, it has been pointed out that the treatments of some paraphilia sex crimes, such as frotteurism and exhibitionism, have not been satisfactorily applied. A paraphilia sufferer is apt to commit sex crimes and is of high recidivism rate. There has been no consensus on the criminal disposal and treatment of paraphilia.This research focuses on the measurement of penalty and treatment of exhibitionism (public indecency). Adopting documentary analysis, this research aims to (1) analyze the crime modes of public indecency in the last four yeas; (2) discuss the measurement of penalty of exhibitionism; (3) examine whether relevant mental illnesses are involved in cases involving exhibitionism and whether they are considered for the measurement of penalty by the judges.
