高知名度商標制度於兩岸之相互影響與發展

Cross-strait Interaction and Development of the System Involving Highly Well-Known Marks

按我國著名商標與大陸馳名商標制度尚有不同，然二者均屬針對高知名度商標所為的規範與肯定，因此在兩岸頻繁發展的今日，自有相互影響之可能性存在。本文首先針對兩岸關於著名及馳名商標之認定制度進行比較，之後，再針對兩岸企業對於高知名度商標所具有之認知與期待、此等高知名度商標對兩岸企業之發展的潛在影響、及橫跨兩岸企業申請我國灣著名與大陸馳名商標之模式與策略加以觀察，最後則嘗試透過兩岸現行之高知名度商標制度，提出修法、資源共享、以及兩岸商標制度之交錯適用或相互承認等建議。

The Famous Trademark system in Taiwan and the Well-known Trademark system in China which are both applied for highly well-known marks affect each other today. Accordingly, this article will firstly compare the characters of Famous Trademark system in Taiwan and Well-known Trademark system in China. Secondly, it will focus on the understanding and expectation of the cross-strait corporations on highly well-known marks, the potential effect and impact of such trademark for the cross-strait corporations, and the strategy and model for registering the Famous Trademark in Taiwan and the Well-known Trademark in China. Finally, this article will provide some suggestions involving amendment of trademark laws, information and resource sharing, and interaction or cross-recognition of cross-strait trademark systems based on the current highly well-known mark system.
