漢代法制研究新取徑──以《二年律令》與《名公書判清明集》的禁賭為例

A New Approach to Han Legal History: Gambling Prohibition in The Legal Texts of the Year Two and The enlightened judgments in Light of the Assumption of Historical Continuity

史料不足是古代史研究的普遍困境。透過歷史延續性將古代與後世聯繫起來，運用後世材料以解釋古代史，是值得嘗試的方法。本文排比漢唐宋禁賭法律，指出其延續性；繼而援引南宋判例裡的實際禁賭措施，分析漢代擁有與宋代相似的環境與條件，推測漢代可能也有類似的禁賭措施。本文希望藉由小小的研究課題，對跨斷代史料學提供一點正面的支持。

In order to circumvent the paucity of sources this paper, assuming continuity between the respective dynasties, attempts to interpret Han legal history based on a comparison with later materials stemming from the Song period. In the case at hand, Han laws prohibiting gambling are examined and interpreted against the backdrop of like policies enacted during the Southern Song. The similarities of the laws in regard to content as well as social and political factors enable us to argue for the existence of corresponding policies during the Han dynasty.
