我國基因改造作物產業利用管理體系之法制初探

A Preliminary Study of Managemnt in Genetically Modified Crop Production System in Tawan

我國在基改作物管理法規體系上，採分散式立法。在採取「預防原則」與「共存原則」的前提下，制訂相關的管理法規架構。儘管我國基改作物的管理法規體系已有初步的結構，但仍有若干問題欠缺規範，亟待補正。本文嘗試就我國基改作物產業利用管理體系之現行法制法規進行梳理，並就我國基改作物產業利用管理體系之基本原則、法源依據以及相關問題加以分析，並參考外國立法例，提出相對應的解決方案。

In Taiwan, GM crop management regulations system adopts the form of decentralized legislation. Under the “precautionary principle” and the “coexistence principle”, Taiwanese government created management and regulatory framework. Although the management and regulation system of GM has a preliminary structure in Taiwan, there are still some problems that lack specifications and need to be completed. This paper attempts to clarify the current legal regulations of Taiwan GM management system, analysing the basic principles, legal sources and related issues of Taiwan GM utilization management system, and refering to foreign legislation to propose corresponding resolutions.
