論小早川欣吾的東洋法制史研究

Comment on the Research on Oriental Legal History by Kingo Kobayakawa

小早川欣吾是日本京都帝國大學培養的法制史學者。他主要致力於日本法制史的研究，但在去世前十餘年間旁治東洋法制史。他通過撰寫書評，密切追蹤國際學術界的前沿動向；又因具有鮮明的比較法意識和法科本位立場，所以在論著中體現出明確的方法論反思。只可惜他英年早逝，京都大學東洋法制史的學脈也由此而中斷。 Dr. Kingo Kobayakawa was a legal historian trained by Kyoto Imperial University, Japan. He mainly devoted himself to the study of the Japanese legal history, but he paid attention on the research about oriental legal history more than ten years before his death. Through writing book reviews, he closely followed the frontier trends of the international academic community. And because of his distinctive comparative law consciousness, he had demonstrates a clear methodological reflection in his works. It was a pity that he died young, and the research tradition of the oriental legal history in Kyoto University was interrupted.
