法國民事訴訟中的第三人撤銷訴訟,乃容許非司法裁判之當事人,在其本身及代表人均未出現在司法裁判程序的情形下,請求法院宣告該一既存裁判對其不生對抗效力的特殊救濟程序。這樣的特殊救濟程序,不僅構成了法國民事訴訟法制中最突出之特徵之一,也影響及於若干歐洲國家法制。然而,第三人撤銷訴訟並非發生對受攻擊裁判撤銷之效果,僅得對於請求人請求之事項,發生對抗效力。本文乃針對法國民事訴訟法相關規定,分析整理法國現行制度中第三人撤銷訴訟裁判效果。其目的不僅在究明法國此一特殊制度的真實面貌,同時也為我國民事訴訟法第507之一條以下的相關制度,提供比較法上不同的觀察視野。
A third-person opposition proceeding in French law means an approach which allows a third-person, who was not presented by himself or by a representative in the judicial process, to withdraws a judicial decision, which has an effect damageable against him . Such a special remedy procedure constitutes not only one of the most prominent features of the French civil procedure and legal system, but also affects a number of European countries. However, the third party's opposition proceeding does not have the effect of revoking or annulation the attacked judicial decision, and only has to be effective against the requester. This article is based on the relevant provisions of the French Civil Procedural Law, analyzes and clarifies the effectiveness of the third party to revoke third-person opposition proceeding in the current French system. Its purpose is not only to study the true features of this particular system in France, but also to provide a different perspective on the comparative law for the relevant systems under Article 507-1 of the Civil Procedure Law of Taiwan. |
